Prosecution to hand over Sia Figel’s medical report

Apia, Samoa – 30 April 2025 – The Prosecution in the Papalii Sia Figel murder case has agreed to hand over the accused’s medical report to defence counsel after the Tanumalala Prison Commissioner, Afamasaga Samuelu disallowed it.

Defence counsel Unasa Iuni Sapolu told Talamua that the prison doctor, Leausa Dr. Take Naseri has assessed Papalii twice during his visits to the prison.

Unasa asked Dr. Naseri for a copy of his report which he agreed to, however, Afamasaga did not allow it.

Unasa then raised the issue with prosecutor Taimalelagi Leinafo Strickland who sought from Afamasaga reasons for disallowing the submission of the report to defence counsel.

She later agreed to hand over the medical report.

Unasa said  every trial document should be made available to both parties in a case and if the other party refuse, then an application to the court for discovery documents are submitted for an order.

Papalii has pleaded not guilty to the charges of murder, armed with a dangerous weapon, grievous bodily harm and manslaughter in the death of Sinavaiana Dr. Caroline Gabbard in June 2024 and the hearing is scheduled for August.

However, finalising all preliminary matters including the medical reports is adjourned to 6 May 2025.
