Court directs Falealili 1 unchallenged evidence for mention in Criminal Court

Apia, SAMOA – 25 March 2026: In its decision that declared void the Parliamentary seat of Falealili 1 yesterday, the Electoral Court also noted that this certain case has proceeded under “unprecedented circumstances distinguished by unchallenged evidence of a $100,000 bribe offered to induce its withdrawal.”

The court decision said such circumstances warrant further actions to safeguard the integrity of the electoral process and uphold the courts constitutional responsibility.

The Court decision directed the Registrar to refer the evidence to the Office of the Attorney General to enforce the law.

The matter is scheduled to be mentioned in the Criminal Court this morning.

The Petition was brought by unsuccessful HRPP candidate, Tuiloma Laniselota Lameko and the decision confirmed corrupt practices against Member of Parliament Toelupe Poumulinuku Onesemo who is also the Deputy Prime Minister prior to the August 2025 general election.

The court is satisfied with proof provided through the actions of his election campaign agent Petelo which included offering to transport Nofovaega to attend a sign-up meeting to support the Respondent on a Sunday before the election.

There was also a transfer of $150 to Nofovaega with the intention to entice his vote for the Respondent.

“The Respondent is liable for Petelo’s action therefore the Respondent is found guilty beyond reasonable doubt of the corrupt practice carried out by Mr. Petelo,” said Chief Justice Perese.

The court also highlighted that the Respondent did not prosecute his corrupt practices against the Petitioner and it is accordingly struck out.

The court will report its findings to the Speaker.
